Eligibility for expungement

To expunge a first-time DUI, you have to meet certain conditions. You must complete all court-ordered requirements, including probation and fines. Additionally, you have to let a set amount of time pass since you completed your sentence, typically five years. 

Types of expungement

Oklahoma offers two main types of expungement for DUI records, including: 

  • A Section 18 expungement allows the court to seal your arrest records. To be eligible, you have to complete your sentence (including fines and probation), wait five years, have no pending charges, and it has to be your first offense. 
  • A Section 991c expungement pertains to court records.  To be eligible, you have to get and complete a deferred sentence, have no misdemeanor or felony convictions, have no pending charges, wait a few years after you finish your sentence and get court approval.

Both types can help minimize the visibility of your DUI record.

Expungement process

You will need to file a petition in the district court where the DUI occurred. This petition includes details about your case and the reasons for seeking expungement. After filing, the court will schedule a hearing to review your request. If the court approves your petition, they’ll seal or clear your record.
